Terms of Service

Welcome to PromptBite. These Terms of Service (“Terms”) govern your access to and use of the PromptBite iOS app and promptbite.app (together, the “Service”), operated by PromptBite, Inc. (“PromptBite,” “we,” “us”). By downloading, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use the Service.

1. Who can use PromptBite

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service. By using it, you confirm you meet this requirement and that the information you provide is accurate.

2. Your account

PromptBite uses Sign in with Apple. Your Apple ID is your PromptBite account — there’s no separate password to manage. You’re responsible for activity that happens under your account and for keeping your Apple ID secure. Contact us at hello@promptbite.app if you believe your account has been compromised.

3. What PromptBite does — and its limits

PromptBite is an AI cooking assistant. It suggests recipes, recognizes ingredients from photos you take, builds a grocery cart, and guides you through cooking. The Service relies on artificial intelligence and third-party data, which means it can be incomplete or wrong.

Allergies and dietary needs: PromptBite lets you set allergies as a constraint and re-checks AI recipes against an allergen list, but it can still make mistakes. Always read a recipe’s ingredients yourself if you have an allergy or dietary restriction. PromptBite is not a medical service and is not designed or marketed as safe for severe allergies. Nothing in the Service is medical, nutritional, or health advice.

Food safety: You are responsible for safe food handling, storage, cooking temperatures, and using your own judgment in the kitchen.

4. Subscriptions and billing

PromptBite is free to start, with monthly limits on certain features. PromptBite+ (Premium) removes those limits. Subscription terms:

• Price: $9.99 per month, or $79.99 per year (prices may vary by region and are shown in the app before you buy).
• Free trial: new accounts may receive a 7-day free trial of Premium. If you don’t cancel before the trial ends, it converts to a paid subscription.
• Billing: subscriptions are sold as auto-renewable in-app purchases and are billed through your Apple App Store account. Payment is charged at confirmation of purchase.
• Auto-renewal: your subscription renews automatically for the same period unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
• Managing and canceling: manage or cancel anytime in iOS Settings → your name → Subscriptions. If you cancel, you keep Premium until the end of the period you’ve already paid for. We don’t provide separate refunds for partial periods; refunds are handled by Apple under the App Store terms.

We may change subscription prices or features. If a change affects your current plan, we’ll give notice as required and, where applicable, the change takes effect at your next renewal.

5. Third-party services

The Service works with third parties, and your use of them is governed by their own terms:

• Apple — the App Store, Sign in with Apple, and subscription billing.
• Amazon — if you connect it, PromptBite assembles a cart and hands it off, but every order, price, payment, delivery, and substitution is completed by you within Amazon and governed by Amazon’s terms. PromptBite does not sell groceries and is not responsible for products, prices, availability, or delivery.

PromptBite is not affiliated with, and does not endorse, Amazon or the retailers available through it. PromptBite participates in the Amazon Associates program and may earn commissions on qualifying orders. Recipe and product information may come from third-party sources and can contain errors.

6. Acceptable use

You agree not to: misuse or interfere with the Service; attempt to access it in unauthorized ways; reverse engineer or scrape it except as allowed by law; use it to break the law; or use it to harm others. We may suspend or terminate access if you violate these Terms or misuse the Service.

7. Your content

You keep ownership of the photos, prompts, and preferences you provide. You grant PromptBite a limited license to use that content solely to operate and improve the Service for you — for example, sending a photo to our AI provider to recognize ingredients, as described in our Privacy Policy. You’re responsible for the content you submit and confirm you have the right to submit it.

8. Our intellectual property

The Service — including the PromptBite name, app, design, and software — is owned by PromptBite and protected by intellectual-property laws. These Terms don’t grant you any right to our trademarks or branding. AI-generated recipe text returned to you is yours to cook from and use personally.

9. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We don’t warrant that the Service will be uninterrupted, error-free, or that recipes, ingredient detection, savings estimates, or product data will be accurate or suitable for you.

10. Limitation of liability

To the fullest extent permitted by law, PromptBite and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid PromptBite in the 12 months before the claim, or US $50. Some jurisdictions don’t allow certain limitations, so some of these may not apply to you.

11. Indemnification

You agree to indemnify and hold PromptBite harmless from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Service or your violation of these Terms or applicable law.

12. Termination

You can stop using the Service at any time and delete your account by contacting us. We may suspend or end your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will survive.

13. Changes to these Terms

We may update these Terms from time to time. When changes are material, we’ll update the “Last updated” date above and, where appropriate, notify you in the app. Your continued use of the Service after an update means you accept the revised Terms.

14. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Any dispute will be handled in the courts located in Delaware, unless applicable law requires otherwise or gives you rights in your home jurisdiction.

15. Apple-required terms

These Terms are between you and PromptBite, not Apple. Apple is not responsible for the Service or its content. To the extent the App Store’s standard Licensed Application End User License Agreement applies, it supplements these Terms; where the two conflict for App Store usage, the applicable Apple terms control for that usage. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
